These Terms of Service ("Terms") govern your use of the Hallodesk platform ("Service"), a cloud-based SaaS product for AI-powered customer communication and appointment management, operated by:

By creating an account, you agree to these Terms. If you are using the Service on behalf of a company, you confirm that you have the authority to bind that company to these Terms.
Hallodesk provides:
The Service is provided "as is" and features may be added, modified, or removed as the platform evolves.
You must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your login credentials. One account corresponds to one business. Multi-location setups require separate accounts or an Enterprise plan. You must be at least 18 years old or have legal capacity to enter into contracts.
Certain subscription plans may feature a free trial period or a Freemium tier. At the end of a trial, you must select a paid plan to continue using the Service's premium capabilities. If no plan is selected, your account may be suspended or limited, and your data will be retained for 90 days.
Plans are billed monthly or annually in advance via Stripe. All prices are in Euros and exclude applicable VAT. German VAT (currently 19%) will be added for customers within Germany. We will notify you at least 30 days in advance of any price changes, taking effect at the next billing cycle.
Each plan features specific monthly usage limits (e.g. voice chats per month: Freemium 50, Starter 200, Pro 600). Telephony voice minutes and SMS/WhatsApp messages used beyond your plan's included allowance are billed at the per-unit rates specified on our pricing page.
You agree to use the Service only for lawful purposes and in compliance with all applicable regulations, including GDPR, TDDDG, and German competition laws (UWG). You must not use the AI receptionist for spam calling or harassment. You must ensure that your customers are informed about AI-assisted communication as required by law.
You retain full ownership of all business data, customer data, call recordings, and other content you create or upload. We process this data solely to provide the Service under a Data Processing Agreement (AVV) per Art. 28 GDPR, available upon request.
We target 99.5% uptime for the platform, excluding scheduled maintenance. To the maximum extent permitted by German law (§276, §278 BGB), our liability is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect or consequential damages, or the accuracy of AI-generated responses.
You may cancel your subscription at any time from your settings, taking effect at the end of the billing period. We may suspend or terminate your account if you violate these Terms, fail to pay, or use the Service in a way that harms other users or our infrastructure.
These Terms are governed by the laws of the Federal Republic of Germany, excluding the CISG. The exclusive place of jurisdiction for all disputes is Regensburg, Germany.
